ARTICLE 1 - SCOPE & DEFINITIONS
A. Scope & Implementation:
  1. The purpose of this chapter is to further the equality of the educational opportunity and success for all students in California community colleges by providing access to health services which promote the physical, emotional and social well-being of its students. This chapter sets forth minimum standards for district health services programs and further elaborates requirements for personnel, financial and budget considerations, facilities and environment, and evaluation.
  2. The requirements of this chapter apply only to districts receiving funds pursuant to Education Code Section 76355 for the period of time during which such funds are received. The Chancellor shall, in consultation with districts and other interested parties, adopt a schedule for implementing the provisions of this chapter as expeditiously as possible within the constraints of available funding.

B. Definitions:

For purposes of this chapter, the following definitions shall apply:

  1. Student Health Services- the organization or unit within the college that provides programs and activities designed to facilitate the physical and emotional well-being of students so as to contribute toward the educational aims of community colleges including student retention and academic success. The student health service as an integral part of the college, supports its objectives and receives support from the college in performing its responsibilities.
  2. Student Health Services Advisory Committee- group of individuals from specified college who may advise Health Services staff regarding policies, practices, and/or services for health services. Membership shall include representatives from administration, faculty, students, staff, and community.
  3. Clinical Care Services - a basic primary care program which provides acute, episodic care that includes, but is not limited to:
    1. assessment, intervention, and referral for health services
    2. first aid and basic emergency care
    3. health appraisal
    4. communicable disease control.
  4. Mental Health Services - a basic intervention program which provides direct and/or referral services including but not limited to:
    1. crisis management
    2. short term psychological counseling
    3. alcohol/drug counseling
    4. eating disorders counseling
    5. stress management
    6. suicide prevention
    7. sexual harassment/assault recovery counseling program
    8. mental health assessment.
  5. Support Services - a variety of services supporting the clinical and mental health efforts including but not limited to: maintenance of health records in a confidential and ethical manner laboratory, radiology, and/or pharmacy services.
  6. Special Services - additional specialized services to further promote the over- all goal of student health including but not limited to:
    1. health education and promotion
    2. teaching and research
    3. student insurance program
    4. environmental health and safety, including illness and injury prevention programs.
  7. Ethical and professional relationships - issues related to the ethics and code of a professional practice such as confidentiality practices, admission health information, protection from research, patient rights and responsibilities, privacy, informed consent.
ARTICLE 2 PLANNING & ADMINISTRATION
A. Health Services Plans:
  1. The Board of Trustees of each community college shall adopt a health services plan which makes provisions for services to be provided to its students. The plan shall include, but not be limited to, a description of the types and scope of services which will be delivered, policies relating to patient care and follow-up care, the district's budget for health services, personnel on the health services staff, plans for professional development, and methods of evaluation. In districts with more than one college, a plan shall be developed for each college.
  2. The plan shall be developed in consultation with a student health services advisory committee, which shall include representatives of administration, faculty, students, and staff; and may include public representation.
  3. The plan shall conform to the requirements of this chapter, as well as the local, state and federal requirements related to delivery of health care. Individual campus plans shall be submitted to their districts for approval. Districts may require periodic updates of such plans.
  4. The plan for student health services shall include, but not be limited to, the following components:
    1. Clinical Care Services
    2. Mental Health Services
    3. Support Services
    4. Special Services, including health education and promotion
    5. Ethical and Professional Relationships
  5. The plan shall be administered in a manner that assures the provision of appropriate health services that contributes to the institutional mission of the college.

B. Personnel:
  1. Personnel employed in the student health services shall meet minimum qualifications for health services professionals as put forth in Section 53411 of Subchapter 4 of Chapter 4 of Division 6 of Title 5 of the California Code of Regulations.
  2. The specific scope of practice of health service professionals is regulated by the licensing Board of that profession.
  3. Provision shall be made for improving the professional competence and skill, as well as, the quality of performance of the health care practitioners and other personnel employed in student health services.
  4. Health Services staff shall actively participate with the college in developing institutional policies and practices that have direct impact on the health and safety of the campus.

C. Financial & Budget Requirements:
  1. When establishing student health fee funds, the financial and budget requirements for the student health services shall meet the specifications as put forth in Section 76355 in the Education Code.
  2. When the support of student health services is shared by all students through a fee, programs and services must address the health care needs of the general student population. Specialized services designed to meet the health care needs of select student groups may be provided by health services when augmented by additional fees and/or special funding.
  3. Authorized expenditures shall be linked to direct services rendered to students.
  4. The percentage of the salary of any personnel directing health services which is funded by the restricted student health fee fund shall not be greater than the percentage of time spent in such directing.

D. Facilities & Environment:
  1. Student health services shall provide a functionally safe and sanitary environment for its patients, personnel, and visitors appropriate to its defined scope of services.
  2. Student health services facilities shall comply with all applicable federal, state, and local building codes and regulations.
  3. Student health services shall arrange for the necessary personnel, equipment, space, and supplies to meet the delivery of health care needs of the students and the scope of services offered.

E. Evaluation:
  1. Each community college district shall establish a program of institutional data collection/research for the effectiveness of its student health services in complying with the requirement in this chapter. The evaluation shall include, but not be limited to:
    1. the assessment of the quality of care and customer satisfaction with services and facilities of the college health service
    2. establishment of an active, organized health service peer-based quality assurance process
    3. involvement of the student health advisory committee in the evaluation of student health services.
  2. The Chancellor for the community college shall establish a method for evaluation of the student health services on a statewide basis utilizing the data from the community college health services.
